Indeed he did. And he does have more rights by law. But like it or not, I am not obligated to care about orders after Kickstarter if I don't have my stuff yet. Does that make me selfish for wanting mine first? Yeah, probably a little. :-)
I do care though, because it affects the health of the company. I'm afraid you're right about them making everyone upset equally. In the early days of this company, upsetting some chunk of the first adopters, no matter how they supported (KS or store) is not a great move.
And I agree the company is messing up by selling product before fulfilling their original Kickstarter obligations. I agree they need much better communication for all the delays. At the very least, they should have known early that they were delayed and changed the delivery timing on the store website by a month. That seems like a no-brainer. But you seem to be correct that they are getting everyone upset with lack of info. Many of us KS backers have been saying the same, we don't mind waiting, but give us an idea of how much longer.
